2.3 The User must not impersonate another person or knowingly provide false or misleading information, or information that may cause harm to another person.
3. NATURE AND SCOPE OF THE COMPANY’S SERVICES
3.1 NursingHomesThailand.com is a platform providing information, publicity, search, preliminary screening, recommendation, and coordination services to assist Users in locating Care Facilities that may be suitable for the needs of Care Recipients.
3.2 The Company may provide services including:
(a) searching for Care Facilities based on location, budget, type of service, or the User’s requirements;
(b) displaying information and details of Care Facilities;
(c) preparing a list of Care Facilities that may be suitable for the User’s requirements;

(g) following up on coordination; and
(h) providing other services related to the foregoing purposes.
3.3 The Company may modify, add, or discontinue certain Services as appropriate, taking into account Users’ rights and applicable legal requirements.
4. THE COMPANY IS NOT A CARE FACILITY OR MEDICAL SERVICE PROVIDER
4.1 The Company provides information, recommendation, and coordination services only. The Company is not an elderly care facility, hospital, clinic, medical service provider, or healthcare professional.
4.2 The Company does not itself provide care to Care Recipients and has no duty to control, manage, or supervise the operations, personnel, or services within any Care Facility.
4.3 The Company is not an agent of the User or any Care Facility and has no authority to enter into service agreements, receive payments, determine or change prices, grant discounts, guarantee the quality of care, or otherwise bind a Care Facility, unless specifically agreed or authorized.
4.4 Any agreement for care or accommodation services shall be entered into directly between the User and/or the Care Recipient and the relevant Care Facility and shall be subject to the terms of that Care Facility.
5. RESPONSIBILITIES OF CARE FACILITIES
5.1 Each Care Facility is directly responsible for deciding whether to accept or decline a Care Recipient, assessing suitability, entering into service agreements, care, personnel, equipment, premises, safety, medication administration, emergency response, referral for medical treatment, and obtaining and maintaining any licences or registrations required by law.
5.2 Each Care Facility determines its own prices, service fees, security deposits, promotions, room types, availability, admission conditions, and terms of service.
5.3 The Company has no authority to require a Care Facility to accept a Care Recipient or to provide services at a price, on terms, or for a duration requested by the User.
6. SEARCH AND RECOMMENDATION OF CARE FACILITIES
6.1 The Company may consider information provided by the User, such as preferred location, type of care, preliminary health information, budget, special requirements, and information about Care Facilities in order to prepare a list of, or recommend, Care Facilities that may be suitable.
6.2 Search results, rankings, recommended lists, or matching results are provided solely as tools for the User’s convenience and do not constitute an endorsement, guarantee, or professional recommendation that any Care Facility is the best or most suitable facility for a Care Recipient.
6.3 Users should exercise their own judgment and independently review a Care Facility before making a decision, including by visiting the premises and checking licences, personnel qualifications, safety systems, care arrangements, prices, service agreements, and payment terms.
6.4 The Company does not guarantee that a recommended Care Facility will have a bed or room available, will accept the Care Recipient, or will be able to provide services meeting the User’s requirements.
7. INFORMATION ABOUT CARE FACILITIES ON THE WEBSITE
7.1 Information such as names, images, logos, locations, service details, prices, promotions, facilities, room types, and other information about Care Facilities may be supplied or confirmed by the relevant Care Facility or obtained from sources that the Company is entitled to use.
7.2 The Company will use reasonable efforts to present information accurately and keep it current; however, certain information, such as prices, promotions, availability, or personnel, may change without the Company being immediately notified.
7.3 Before entering into an agreement, making payment, or receiving services, the User is responsible for reconfirming material information directly with the relevant Care Facility.
7.4 If information about a Care Facility is inaccurate or outdated, the User may notify the Company so that it may be reviewed and corrected.
8. CARE FACILITIES WITH AND WITHOUT A BUSINESS RELATIONSHIP WITH THE COMPANY
8.1 Some Care Facilities displayed or recommended through the Website may have a collaboration agreement or other business relationship with the Company, while others may not yet have entered into a full collaboration agreement with the Company.
8.2 The display of the name or information of a Care Facility on the Website does not constitute a representation that the Company has verified every fact concerning that Care Facility.
8.3 Where the Company does not have a direct collaboration agreement with a Care Facility, the Company may have only limited information regarding that facility’s operations, licences, or services. Users should therefore verify relevant information directly with the Care Facility and, where appropriate, the relevant authorities before making a decision.
9. BUSINESS RELATIONSHIPS AND COMPENSATION
9.1 The User acknowledges that the Company may have a business relationship with certain Care Facilities and may receive a commission, service fee, or other compensation from a Care Facility where a User or Care Recipient referred by the Company receives services in accordance with the terms agreed between the Company and that Care Facility.
9.2 Receipt of compensation from a Care Facility does not make the Company a care provider or a party to the service agreement between the User and the Care Facility.
9.3 If the Company charges any fee directly to a User, the Company will disclose the applicable price and terms to the User before the User becomes obligated to make payment.
10. INFORMATION PROVIDED BY USERS
10.1 The User agrees to provide information that is accurate, complete, and current to the extent necessary for the provision of the Services.
10.2 Such information may include name, contact information, preferred location, budget, care requirements, and preliminary information about the Care Recipient.
10.3 The User should notify the Company if previously provided information changes and such change may affect the search for or coordination with a Care Facility.
10.4 The Company is not responsible for verifying the accuracy of information provided by the User or another person, and each Care Facility remains responsible for assessing and verifying information necessary before accepting a Care Recipient.
11. HEALTH INFORMATION AND SENSITIVE PERSONAL DATA
11.1 In order to search for or match a suitable Care Facility, the Company may need to receive information relating to a Care Recipient’s health, dependency, ability to perform activities of daily living, underlying medical conditions, behavior, medication use, or care requirements.
11.2 The Company will collect, use, or disclose such information only to the extent necessary and on an applicable lawful basis. Details regarding the processing of personal data are set out in the Company’s Privacy Policy / Privacy Notice.
11.3 Where applicable law requires explicit consent in relation to health information or sensitive personal data, the Company will obtain such consent as required by law.
11.4 Acceptance of these Terms alone does not replace any separate consent that is required by law.
12. DISCLOSURE OF INFORMATION TO CARE FACILITIES
12.1 When the User asks the Company to assist in searching for, recommending, or coordinating with Care Facilities, the User acknowledges that the Company may need to disclose relevant information to one or more Care Facilities so that they may assess suitability, check availability, provide pricing information, or contact the User.
12.2 The Company will disclose only information necessary for the purpose of providing the Services and will do so in accordance with its Privacy Policy and applicable personal data protection laws.
12.3 Once a Care Facility receives information and collects, uses, or discloses such information for its own purposes, that Care Facility may have separate status and obligations under applicable personal data protection laws.
13. CONTACTING USERS
13.1 When the User completes a form, contacts the Company, or requests Services, the User acknowledges that the Company may contact the User by telephone, mobile phone, email, LINE, SMS, chat, or any other contact channel specified by the User in order to process the request, provide information, arrange an appointment, or follow up on the Services.
13.2 Where necessary for the Services, the Company may coordinate for a relevant Care Facility to contact the User directly.
13.3 Communications made to fulfill the User’s request for Services shall be distinguished from newsletters, promotions, or direct marketing. Where applicable law requires consent for marketing communications, the Company will obtain such consent as required by law.
14. THE COMPANY DOES NOT PROVIDE MEDICAL ADVICE
14.1 Information, articles, questionnaires, search results, matching results, responses, or general recommendations displayed through the Website are provided solely for informational purposes and to facilitate the search for Care Facilities.
14.2 Such information does not constitute diagnosis, medical assessment, prescribing of medication, treatment, or advice from a physician, nurse, pharmacist, or other healthcare professional.
14.3 The Company has no duty to determine whether a Care Recipient is medically suitable for any Care Facility or whether a particular Care Facility has sufficient clinical capability for a particular Care Recipient.
14.4 Users should consult an appropriate healthcare professional before making decisions concerning health, treatment, or changes to medication.
14.5 If a Care Recipient experiences a medical emergency or life-threatening condition, the User should immediately contact the emergency medical services at 1669 or an appropriate healthcare facility and should not wait for a response or coordination from the Website.
15. USER DECISIONS
15.1 The selection of a Care Facility, visits, entry into agreements, stays, payments, and selection of services are decisions of the User and/or the Care Recipient.
15.2 The User should read and understand the Care Facility’s agreement before signing, particularly provisions concerning service fees, security deposits, refund conditions, termination, care arrangements, hospital referral, and additional charges.
15.3 The Company does not warrant that any Care Facility will be able to satisfy all specific needs or expectations of a User.
16. PROMOTIONS, CREDITS, AND SPECIAL SERVICES
16.1 The Company may from time to time offer promotions, credits, discounts, trial stays, or other special services.
16.2 Such services may be subject to additional specific terms, including duration, User eligibility, number of available entitlements, fees, or conditions of use, which the Company will disclose to the User.
16.3 If specific terms for a promotion or special service conflict with these general Terms, the specific terms shall apply to that service or promotion to the extent they are not contrary to law.
17. PERMITTED USE OF THE WEBSITE
17.1 The Company permits the User to access and use the Website for personal purposes in searching for information or using the Services in accordance with the purposes of the Website.
17.2 Such permission does not transfer to the User any ownership, copyright, trademark, or other intellectual property right.
18. PROHIBITED USE

19. USER ACCOUNTS AND SECURITY
If the Website provides User accounts, the User is responsible for keeping usernames, passwords, OTPs, and other authentication information confidential and must promptly notify the Company if the User knows or suspects that another person has accessed the account without authorization.
The Company may temporarily suspend access to an account where there are reasonable grounds to believe that the account is being misused or may affect system security.
20. INTELLECTUAL PROPERTY
20.1 The Website, trade names, trademarks, logos, website design, software, databases, text, articles, images, graphics, and content owned by or licensed to the Company are protected under applicable law.
20.2 The User has no right to reproduce, modify, publish, distribute, sell, lease, or commercially exploit such content unless authorized by the relevant rights holder.

21. COMMENTS, REVIEWS, AND USER CONTENT
Where the Website allows Users to submit reviews, comments, or other content that may be made public, the following provisions shall apply:
21.1 Users must provide information or opinions in good faith and must not publish content that is unlawful, defamatory, infringes the rights of others, discloses personal data without lawful authority, or is intentionally false.
21.2 The User retains ownership of content in which the User has lawful rights, but grants the Company permission to use, reproduce, format, display, and publish such content to the extent necessary for providing the Services and operating the Website.
21.3 The Company may suspend, hide, or remove content where there are reasonable grounds to believe that the content is unlawful, infringes another person’s rights, or violates these Terms.
22. THIRD-PARTY LINKS AND SERVICES
22.1 The Website may contain links to or integrations with third-party websites, applications, maps, payment systems, or services.
22.2 The Company does not control the content, security, privacy policies, or terms of such third parties.
22.3 Once a User leaves the Company’s Website, use of third-party services will be subject to the terms and policies of the relevant third-party provider.
23. SYSTEM AVAILABILITY
23.1 The Company will use reasonable efforts to keep the Website available but does not guarantee that it will be available at all times or free from errors, interruptions, or technical threats.
23.2 The Company may temporarily suspend the systems for maintenance, system improvements, security remediation, or compliance with law.
24. LIABILITY RELATING TO SERVICES PROVIDED BY CARE FACILITIES
24.1 Care, medication administration, food, transfers, nursing, treatment, safety, accidents, injury, illness, death, or damage occurring during the provision of services are matters for which the relevant Care Facility or other person involved in providing such services shall be responsible in accordance with law and the applicable service agreement.
24.2 The Company is not liable on behalf of a Care Facility for any act or omission of the Care Facility, its personnel, agents, or contractors.
24.3 However, this Clause does not exclude the Company’s liability for loss or damage arising from the Company’s own acts where the Company is liable under applicable law.
25. LIMITATION OF THE COMPANY’S LIABILITY
25.1 To the extent permitted by law, the Company shall not be liable for indirect, special, or consequential damages, or for loss of profits, revenue, business opportunities, or reputation arising from the use of, or inability to use, the Website or Services.
25.2 The Company shall not be liable for loss or damage arising from information prepared by a Care Facility or third party where the Company did not know that such information was inaccurate and did not intentionally or through gross negligence present such information.
25.3 The Company does not guarantee that all information on the Website will be error-free or current at all times, particularly information that may change, such as prices, promotions, and availability.
25.4 Nothing in these Terms excludes or limits the Company’s liability where applicable law prohibits such exclusion or limitation.
26. LIABILITY FOR IMPROPER USE
To the extent permitted by law, where loss, expense, or a claim arises directly from the User’s intentional unlawful use of the Website, infringement of another person’s rights, breach of these Terms, or fraudulent provision of information, the User shall be responsible for the resulting loss or damage in accordance with law.
27. SUSPENSION OR TERMINATION OF SERVICES
The Company may suspend, restrict, or terminate Services to a User where there are reasonable grounds to do so, including where the User:
